Neutral Case Evaluation/Consultation

Neutral Case Evaluation is a form of alternative dispute resolution in which a neutral evaluator reviews information provided by the parties (including written and/or oral presentations) and provides an assessment of the merits of the case and how the case might be resolved.  The format of a Neutral Case Evaluation can be flexible based upon the agreement of the parties in consultation with the Neutral.  The Neutral typically will prepare a non-binding recommendation as to the likely outcome on key issues and/or the overall value of the case.  Neutral Case Evaluations can be an effective tool to assist parties who have reached an impasse in settlement negotiations due to significantly different views on key legal or factual issues and serve as a “reality check” of the parties’ independent case evaluations. 

Parties and counsel may elect to work individually with an independent evaluator or consultant with a breadth and depth of experience in the subject matter of their case. A neutral evaluator can help evaluate strengths and weaknesses, assess risks, develop case themes and strategies, assist in witness evaluation and preparation, advise discovery strategies, and provide insight into settlement value.
