Allen does this by bringing to each mediation and arbitration:

an in-depth understanding of the interests of the parties to a commercial transaction. He sees all sides of a dispute and understands the needs and motivations of all parties;

an innate ability to find solutions to issues and problems. A key to Allen’s success as a commercial transactions lawyer for more than 30 years, has been his ability to help the parties find solutions to issues and problems that worked for both parties;
an in-depth knowledge of the contracts under which disputes arise, the provisions and issues giving rise to disputes, and the range of resolutions of such disputes. Allen has negotiated hundreds of commercial arrangements including billions of dollars of technology agreements;
a broad and deep understanding of commercial practice, domestically and internationally. Allen has assisted clients with transactions throughout the United States as well as in the United Kingdom, the Netherlands, Germany, Switzerland, Canada, India, and South Africa;
a broad and deep understanding of market practices including software and other technology industry practice;
broad and deep experience assisting personnel with divergent interests reach consensus. Structuring complex commercial and technology transactions required Allen to drive consensus among users, IT executives, business executives, and financial executives when representing customers, and sales and marketing executives, financial executives, developers, and account managers when representing suppliers.

5+ Parties – Mutually agreed flat rate to be shared by parties

Time for advance preparation, pre-session calls with counsel/parties, document review,
research, preparation of written findings, informed arbitration award, or written case
evaluation, and other outside or post-session time, if any, charged at same hourly rates.
MINIMUMS: 3-Hour Minimum will be charged in all cases.

TRAVEL TIME & EXPENSES: No charge for travel for mediations & arbitrations held in Sarasota, FL or Washington, DC.

Outside Sarasota and District of Columbia – Reimbursement of expenses to include mileage at customary
rates or airfare at the cost of refundable coach class ticket, rental car/taxi/rideshare
expenses, and reasonable costs of hotel and meals if overnight stay required. Fees for
travel time to be determined between the parties and the Neutral.

LOCATION FEES: Allen’s offices in Sarasota or Washington, DC – no extra charge. Expenses for alternative office space
(hotel conference center, co-working center conference rooms, etc.) to be shared by the
parties by agreement.

IMPORTANT NOTICES:
ALL CHARGES WILL BE SHARED EQUALLY AMONG ALL PARTIES, UNLESS OTHERWISE
AGREED IN WRITING. PRO SE PARTIES ARE REQUIRED TO PAY AN ESTIMATED DEPOSIT AMOUNT BEFORE MEDIATION DATES ARE CONFIRMED. ANY UNUSED PORTION OF THE DEPOSIT WILL BE REFUNDED AFTER THE CONCLUSION OF THE MEDIATION/HEARING. PAYMENT FOR ANY PRO SE PARTY’S SHARE OF FEES IN EXCESS OF THE ESTIMATED DEPOSIT IS DUE IMMEDIATELY UPON CONCLUSION OF THE MEDIATION, REGARDLESS OF WHETHER A SETTLEMENT IS REACHED.

FOR MATTERS WHERE PARTIES ARE REPRESENTED BY COUNSEL, OUR CONTRACT FOR SERVICES IS WITH THE ATTORNEY(S). WE EXTEND CREDIT, WITH NO ADVANCE DEPOSIT REQUIREMENT FOR MEDIATIONS, BASED ON THE ATTORNEY’S CREDIT. THE ATTORNEY, IN TURN, COLLECTS FROM HIS/HER CLIENT. THEREFORE, WE EXPECT PAYMENT FROM
THE ATTORNEY(S) REGARDLESS OF CLIENT ACTIVITY. ALL FEES MUST BE PAID IN FULL
ON EVERY ARBITRATION PRIOR TO THE AWARD BEING PUBLISHED.
