Settlement Counsel

In bigger cases, it may be productive to have a two-track approach, with one lawyer representing the client for the purposes of preparing for trial and winning the case and a separate lawyer who is focused only on settlement. As long as the roles are appropriately delineated, the use of settlement counsel can often be a cost-effective tool.

Many of our Neutrals have invaluable experience as litigators advocating for their clients in mediations of high-stakes cases. By combining their mediation advocacy skills with their training and experience as Neutrals, they are ideally suited to serve as settlement counsel to negotiate toward a resolution while allowing trial counsel to continue preparing for, and conducting, a trial without distraction.
